By accessing our website and purchasing our products you are entering an agreement to comply to the following terms and conditions:
1. WEBSITE USE
1.1 Eligibility of Use - By using our website and making purchases, you are confirming that you are at least 18 years of age or of legal age to form a binding contract in law.
1.2 Prohibited Use - You must not use our website, images or any information contained within for any illegal and unauthorised purposes. Illegal interruption or interference with the website's operation is not permitted.
1.3 Account - Account creation, confidentiality of credentials and any activity within the account are solely the responsibility of the account holder. We reserve the right to remove accounts if suspicious or unlawful activity is detected.
2. PRODUCT DETAILS, ORDERS AND PAYMENTS
2.1 Product Details - We aim to ensure all product information is accurate and up to date, with these details being monitored regularly. Occasionally incorrect or missing information may occur and will be rectified immediately should we be made aware of this. Pricing and product details are subject to change without prior notice.
2.2 Orders - All orders are subject to acceptance upon completion of payment. We reserve the right to cancel an order for reasons including but not limited to product availability, suspected fraudulent activity, pricing errors or payment processing issues.
2.3 Payments - We accept various payment methods including card transactions, PayPal, Clearpay and Klarna. All payment methods provided by our website are secure. By disclosing payment information you confirm that you have the necessary authorisation to use the chosen payment method and complete the transaction.
3. SHIPPING, DELIVERY AND RETURNS
3.1 Shipping - All orders will be processed and shipped promptly, usually within 1-3 business days. Shipping times can vary depending on the product's availability and the shipping method chosen at checkout. All items will be securely packaged and clearly labelled for delivery. Our packages are insured to cover the product's total value, our higher shipping costs may reflect this to cover the insurance fees.
3.2 Delivery - We are not liable for delays in delivery due to circumstances beyond our control, including but not limited to carrier issues or weather conditions. We require notice to be given within 24 hours should any parcel become damaged or lost in transit. Photographic evidence of the products packaging upon delivery will be required for any items damaged during transit. Most claims will be covered by the additional insurance mentioned in 3.1 and we will contact the customer directly to rectify the issue should this arise.
3.3 Returns - Returns are accepted for unopened products within 14 days of delivery. Please see our Returns and Refunds Policy for further details.
4. INTELLECTUAL PROPERTY
4.1 Content - Website content including images, products, text, logos and designs are the property of HerpStaxx and are protected by the applicable Intellectual Property Laws within the United Kingdom.
4.2 Permission - You are granted limited access and use of our website for non-commercial purposes to view our products, contact us and/or place an order.
5. LIMITATION OF LIABILITY
HerpStaxx shall not be held liable for any direct, indirect, incidental or consequential damages arising out of or in connection with the use of our website or the products purchased.
6. INDEMNIFICATION
You agree to indemnify and hold HerpStaxx and its affiliates harmless from any claims, losses, liabilities, damages and expenses arising from your use of the website or violation of the stated terms and conditions.
7. MODIFICATIONS
We reserve the right to modify the terms and conditions, website and our products at any time. The current version will be shown on the website with the revised date shown as required. By continuing to use our website after any updates to the terms and conditions, you agree to the updated terms.
8. ENCLOSURE USAGE AND SAFETY
We do not accept responsibility for injury and enclosure damaged during installation, regular use, implementation of intense heat sources or during the entrance/inhabitance of water within. It is the customers responsibility to ensure that the enclosure is sealed and operating in the correct way to avoid heat or water damage. Intense, direct and uncontrolled sources of heat should not be used. Please seek advice from a professional when adding water or heat accessories to your enclosure if unsure.
